On April 20, 2007, King County Superior
Court Judge Helen Halpert gave final
approval to a class action settlement in
David Woods, et. al., vs. Bank of America,
N.A. concerning claims for failure to pay
overtime wages to Mortgage Retail Lending
Executives employed in Washington State.
The lawsuit was filed in December 2004
and alleged that Bank of America, N.A.
violated Washington’s Minimum Wage Act by
failure to pay overtime at a rate of not
less than one and one-half times the regular
rate of pay. Bank of America, N.A. has not
admitted liability and agreed to settle the
claims to avoid further protracted and
expensive litigation.
The settlement class consists of those
persons who worked as “Mortgage Retail
Lending Account Executives” in Washington
State at any time between December 9, 2002
and December 20, 2006 (inclusive).
